Getting an open work permit in Canada is easier than you think. Openwork permits allow the holder to accept employment in Canada without any restrictions on location, occupation or type of job. Openwork permits are available to several categories of foreign workers. Let’s find out more about how to obtain an open work permit in Canada.
Who is eligible for an Open Work Permit in Canada?
- International Co-Op students studying in Canada. Openwork permits are available to international co-op work permit holders who have completed at least eight months of their program, full-time studies and who are eligible for an off-campus work permit. This open work permit is valid until the end of your student status. It typically expires along with your study permit.
- International students who have completed their degree or diploma in Canada and are working towards completing a Canadian bachelor's, master's or doctoral program may be eligible for an open work permit if they can prove that they will complete the academic requirements of their current program before the end of their authorized stay. The length of validity is typically three months.
- Foreign workers who are currently working in Canada on a work permit and meet certain eligibility criteria may be eligible for an open work permit if they want to change employers or continue working after their current status expires. Open Work Permits are typically valid until the end of your authorized stay but can range from three months up to two years depending on the eligibility criteria you meet.
- International students who have completed a Canadian post-secondary degree, diploma or certificate and wish to work in Canada after completing their studies may also be eligible for an Open Work Permit if they can prove that they will leave Canada when their current status expires. The length of validity is typically three months.
- Foreign workers who are currently working in Canada on a work permit may be eligible for an open work permit if they have completed their contract of employment with the current employer or if they can prove that their new job is genuine and will create full-time employment. Open Work Permit holders cannot change employers while keeping this status.
How To Apply?
The application process typically takes six months to complete and you will need a number of documents including:
- A written job offer from an eligible employer in Canada, stating clearly what kind of employment they expect to give you.
- Proof that your employment will bring economic benefits to Canada, such as a Labor Market Impact Assessment (LMIA) from Employment and Social Development Canada or in some cases an approved LMO exemption letter. Open Work Permit holders are exempted from the LMIA requirement but still need proof of their eligibility status in order to work without restriction.
- Proof that you finished your studies in Canada, such as an academic transcript or a letter from the school registrar confirming when your degree was completed and issued to you if it is not yet received at the time of application.
- A copy of your current work permit (if available) or proof that you are entitled to apply for a work permit in Canada, such as an application number or receipt notice.
- Proof that you have enough money to support yourself while living and working in Canada, typically through bank statements for the last few months. Open Work Permit holders are not eligible for government financial assistance so they must prove that they will be able to pay their expenses without using social benefits.
- A completed application form and the processing fee in Canadian dollars which is currently C$155 for a three-month permit or C$230 for a six-month permit, plus an additional charge if you need help with translation of your documents.
