Sponsoring Siblings, Nephew, or Niece

Who can sponsor their brother/sister or nephew/niece to Canada?

You can only sponsor your sibling or nephew/niece to live and work in Canada if you’re at least 18 years old and are a:

♦ Citizen of Canada, or
♦ Permanent Resident of Canada, or
♦ Registered in Canada as an Indian under the Canadian-Indian Act

Also, you must either be living in Canada to sponsor your sibling or nephew/niece, or:

♦ You must be a Canadian Citizen who lives abroad; or
♦ You’re planning to return to Canada when your sibling immigrates here

Requirements for Sponsoring Your Sibling to Canada

In order to be eligible to sponsor your brother, sister, nephew, or niece to Canada, you must:

♦ Meet certain income requirements
♦ Give a written agreement that you will financially take care of the person being sponsored for 3 to 20 years depending on their age and your relationship with them

The sponsored person must also give a written agreement that they will make every possible effort to support themselves financially. Dependent children under the age of 19 do not need to make this agreement.

Eligibility criteria and requirements for sponsoring a grandchild or dependent child are also same.

Sponsoring Uncle or Aunt

Defining Uncle & Aunt

Under the Canada Family Immigration Scheme, we can define the uncle and aunt (who are actually eligible for sponsorship) as:

♦ Uncle – Brother of Sponsor’s parents
♦ Aunt – Sister of sponsor’s parents

For sponsoring uncle or aunt to Canada, you must fulfil all the requirements mentioned under “Sponsoring Sibling” section.

In addition to that, you must not have any other family member, nephew or niece, spouse/common-law partner, or any other relative who is the citizen of Canada or who could be sponsored to Canada.

Undertaking

If you sponsor your uncle/aunt to Canada, you must agree to at least 10 years of undertaking, which means you take their financial responsibility for 10 years. In case your uncle’s or aunt’s spouse or conjugal partner is also accompanying them, your undertaking extends to them as well.

Also, if you’re uncle or aunt has a dependent child, you undertaking extends to them as well for 10 years.

You may not sponsor uncle or aunt if you are receiving social assistance from Canadian Government.
